What Is the AI Labeling Requirement?

Under Article 50 of Regulation (EU) 2024/1689, the European Union is introducing a binding requirement to label AI-generated content. The rule specifically targets content created or manipulated by AI systems that could be perceived as real or human-made—such as text, images, voices, or videos.

The goal: transparency and preventing deception, particularly in the case of deepfakes.

As Article 50(4) states:

“Deployers of an AI system that generates or manipulates image, audio or video content constituting a deep fake, shall disclose that the content has been artificially generated or manipulated.”

A similar rule applies to text:

“Deployers of an AI system that generates or manipulates text which is published with the purpose of informing the public on matters of public interest shall disclose that the text has been artificially generated or manipulated.”

There are, however, important exceptions—we’ll get to those in a moment.

When Does the AI Labeling Requirement Take Effect?

From August 2, 2026.

Article 50 is part of Chapter IV of the AI Act. Since this chapter isn’t listed separately in Article 113 (which sets out the timeline for enforcement), the general rule applies—making it legally binding from August 2, 2026.

For context, here’s when the different chapters come into effect:

  • Chapters I & II: from February 2, 2025
  • Chapter III (Section 4), Chapters V, VII, XII, and Article 78: from August 2, 2025
  • Some obligations from Article 6: from August 2, 2027

Which AI-Generated Content Must Be Labeled?

The rule applies to a wide range of AI-generated or AI-enhanced content—especially when it could be perceived as authentic or human-made. The requirement holds regardless of whether the content is published on your own website, social media, or any other digital platform.

According to Article 50(4), labeling is required for:

Text

  • Blog posts, landing pages, social media content
  • Especially when covering topics of public interest

Images

  • Realistic visuals of people or places that appear genuine
  • When it’s not obvious that AI created them

Video & Audio

  • Deepfakes: realistic video clips with simulated people or voices
  • AI-generated voiceovers that imitate real individuals
  • Automatically produced ads or tutorials with virtual “speakers”

Are There Any Exceptions to the Labeling Rule?

Yes—not all AI-assisted content requires disclosure. The regulation outlines several exceptions where no labeling is needed, particularly when human oversight and editorial responsibility are clearly established.

1. Human Review & Editorial Responsibility

If AI-generated content is reviewed and approved by a human before publication—and that person or entity takes responsibility for it—then no label is required.

From Article 50(4):

“This obligation shall not apply (…) where the AI-generated content has undergone a process of human review or editorial control and where a natural or legal person holds editorial responsibility for the publication of the content.”

In practice, that’s nothing unusual: In corporate communications, editorial responsibility typically lies with the publishing party. If someone—either in-house or via an agency—reviews and approves the content, they assume that responsibility automatically.

In short:

  • A full rewrite is not required
  • Human review or approval is enough
  • Once that’s done, labeling is no longer necessary

2. AI as Support, Not the Source

No labeling is needed if AI only helped with:

  • Rewording or phrasing suggestions
  • Spellcheck or grammar corrections
  • Translations
  • Content structure or formatting tips

As long as the core content was written by a human, you’re in the clear.

3. Non-Public Use

If content is used privately or internally—and not published—there’s no obligation to disclose that AI was involved.

4. Satire, Art, and Parody (With Conditions)

Even satirical or artistic deepfakes are generally subject to labeling. However, the regulation allows for a more flexible approach—so the artistic experience isn’t disrupted. A brief disclaimer at the beginning may be enough.

Article 50(4) states:

“Where the content forms part of an evidently artistic, creative, satirical, fictional or analogous work or programme, the transparency obligations set out in this paragraph are limited to disclosure of the existence of such generated or manipulated content in an appropriate manner that does not hamper the display or enjoyment of the work.”

Important: It must still be clear that the content was AI-generated or manipulated.

Where Does the Labeling Requirement Apply?

The obligation to label AI-generated text, images, or videos applies wherever content is published and made accessible to others—regardless of whether it’s on a company website, a social media platform, or within a content tool.

Company Website, Blog, or Newsletter

Once AI-generated content is published on a website, newsletter, or landing page, disclosure is required—unless a human has reviewed or approved the content and it’s clearly not misleadingly human-like.

Examples include:

  • Blog articles, product descriptions, or FAQs directly published from an AI system
  • Automatically published landing pages or teaser texts
  • AI-generated text or visuals in newsletters

Important: This rule also applies to non-EU websites if the content is clearly targeted at users within the European Union. According to Article 2(1)(c) of the AI Act, the regulation applies if “output produced by the AI system is used in the Union.”

But what counts as “used in the Union”?

These factors may indicate that your offering is subject to the regulation:

  • The website is available in an EU language (e.g., German, French)
  • Prices are listed in EUR (rather than USD)
  • Shipping, booking, or contact forms are available to EU residents
  • You run targeted ads in the EU (e.g., Google or Meta campaigns)
  • Your business has branches or partners in the EU
  • Content addresses issues of public interest within the EU
  • Your legal notice or privacy policy references the GDPR

Social Media (Instagram, Facebook, TikTok, YouTube, LinkedIn)

Social media comes with a particularly high risk of AI-generated content being mistaken for human-made—especially in Reels, carousels, talking-head videos, or “personal” captions.

That’s why, in addition to the AI Act, platform-specific labeling rules already apply:

  • TikTok: “AI-generated” labels are mandatory; automatic detection is active
  • Instagram & Facebook: AI content is automatically flagged by Meta; manual tagging is also supported
  • YouTube: Synthetic content (AI voices, deepfakes) must be disclosed during upload

These platform rules apply in addition to the EU legal requirements.

Other Channels and Digital Systems

The law also covers other digital distribution formats, such as:

  • Presentations with AI-generated visuals sent to external recipients
  • Public-facing comments, forum posts, or AI-generated FAQ pages
  • Voicebots or chat systems without a clear disclosure that the responses are AI-driven

Bottom line: If content is published and not clearly identified as AI-generated—and hasn’t been reviewed by a human—it must be labeled.

What Are the Penalties for Failing to Label AI-Generated Content?

How Severe Are the Fines Under the AI Act?

According to Article 99(4)(g) of the AI Act:

“Non-compliance (…) shall be subject to administrative fines of up to EUR 15 000 000 or, if the offender is an undertaking, up to 3 % of its total worldwide annual turnover for the preceding financial year, whichever is higher:”

In practice, that means:

  • Large enterprises risk up to 3% of global annual revenue
  • Startups and small businesses could face fines of up to €15 million
  • Whichever amount is higher applies

What Factors Influence the Final Penalty?

The actual fine depends on several factors, including:

  • The severity, duration, and scope of the violation
  • The number of people affected
  • The company’s market position
  • Its cooperation with authorities
  • Any technical or organizational measures taken to prevent the breach
  • Past violations or whether the issue was flagged by third parties

For small and medium-sized enterprises (SMEs), the lower of the two amounts (flat sum vs. revenue-based percentage) will apply.

Risks arise if:

  • The AI-generated image strongly resembles a real person who hasn’t given consent
  • The content is designed in a way that people could be confused or falsely associated
  • The image appears in sensitive contexts (e.g., political messaging, satire, advertising)

In many jurisdictions, individuals have the right to control the use of their likeness, even if they’re not named.

A key 2024 case from Canada – Moffatt v. Air Canada – ruled that the company was liable for misinformation provided by its AI chatbot, even though the error wasn’t intentional. European courts are likely to take a similar stance.
